A request to remove gravel on a construction lot on Isaac Frye Highway was continued without discussion on Tuesday, at the request of the applicant.

Isaac Frye Holdings LLC and applicant Kenneth Lehtonen have requested two variances to allow gravel excavation at the site, incidental to the construction of a single family home. Gravel excavation was initially started on the site without town approval, despite the lot not being in the gravel extrication zone, prompting a cease and desist order, and the variances were subsequently sought.

Abutters to the property have registered their protests to allowing the continued removal of gravel.

Abutter Andy Burnes wrote in a letter to the ZBA that he has concerns both for the integrity of the town’s aquifer, as well as the precedent set by “[asking] for forgiveness, rather than permission.”

“The denying of this variance sends a clear message indicating the ZBA’s commitment to enforcement, and will actively deter future builders, who may demonstrate the same disregard for Wilton and the ordinances designed to protect the community,” Burnes wrote.

The public hearings began on May 11, and were continued to June 5 to allow the Zoning Board and public to conduct a site walk of the property. Public comment and deliberations were expected to be picked back up on June 8 at the Zoning Board’s scheduled meeting, but at the request of Lehtonen, the hearing was continued until July.
