Syracuse, N.Y. -- Bank of America has agreed to give working mothers break time and private space to express milk at all its locations after federal investigators said the bank failed to do so for an employee in Tucson, Arizona.
The bank, which is headquartered in Charlotte, North Carolina, and employs more than 170,000 people, has agreed to implement physical modifications at all its facilities nationwide over a multi-year period to accommodate nursing mothers when they need to express breast milk, the U.S. Department of Labor said Thursday.
The agreement comes after an investigation by the Labor Department’s Wage and Hour Division found that Bank of America failed to provide “reasonable break time and a space free from intrusion” for a nursing mother to express breast milk at the Tucson location, the department said.
Federal law requires employers to provide reasonable break time for an employee to express breast milk for her nursing child for one year after the child’s birth. Employers are also required to provide a place, other than a bathroom, that is shielded from view and free from intrusion from coworkers and the public to express breast milk.
“The U.S. Department of Labor applauds Bank of America for leading by example and demonstrating how complying with the law benefits everyone,” Wage and Hour Division Administrator Cheryl Stanton said in a statement. “This agreement demonstrates what can be accomplished when government works collaboratively with business to lift up workers and help employers not only meet their responsibilities, but better their environments for their workforce.”
Bank of America serves 66 million consumer and small business clients and operates 4,300 facilities throughout the country, including multiple locations in Onondaga County, according to its website.
